FACT-CHECK: Europe and Australia did not make a joint pact as third-party states to receive ex-president Duterte

CLAIM: Europe and Australia made a pact as third-party states to receive ex-president Rodrigo Duterte.

A YouTube video posted by the channel “NEWSFILES” falsely claimed that Europe and Australia had made a joint pact to act as third-party states to receive former president Rodrigo Duterte after the alleged acceptance of his application for interim release.

Flagged Content: The thumbnail of the video features Duterte in the center, surrounded by photos of what appear to be delegates from Australia and the European Union (EU) shaking hands, as well as judges from the International Criminal Court (ICC). 

  • The caption of the video reads, “BREAKING NEWS: Europe at Australia Duterte Latest Update The Hague VP Sara Atty. Kaufman Panalo na.” 
  • The overlay texts at the top read, “Pinayagan na… Ito ang swerte na matutupad sa kalayaan” (Allowed… This is the luck that will be fulfilled in freedom.)

Our Debunk: The photos used in the thumbnail, which supposedly show Australian Prime Minister Anthony Albanese and European Commission President Ursula von der Leyen shaking hands, came from the bilateral meeting between the two political leaders in Rome on May 18

  • The meeting was about the EU-Australia Free Trade Agreement, not about Duterte’s case.
  • The photos supposedly showing two judges from the ICC deliberating about the Duterte case, were from different cases and years. 
  • One is a photo of ICC Presiding Judge Julia Antoanella Motoc from Duterte’s initial appearance at the ICC this year.
  • The other is ICC Judge Sylvia Steiner during the filing of the case against Jean-Pierre Bemba in 2016.
  • The official ICC documents, court records, and urgent request for interim release, did not mention Australia or the EU as possible third-party states.
